Terms and Conditions
By entering into this Rental Agreement, the Renter (“You”) agrees to and accepts all terms and conditions specified herein and any additional terms, rules, and policies established by AlmoradiCityLiving (“The Landlord”), including those available on the AlmoradiCityLiving website or provided to you in writing. You acknowledge that you have read, understood, and had the opportunity to seek independent legal advice regarding these terms and conditions prior to entering into this agreement.
The agreed weekly rental amount is paid and the additional Mandatory Rental Deposit is 200 Euro, which will be refunded via IBAN transfer up to 14 days after Inspection of the property after renter check out, if there is no damage to the property or furniture with the below exceptions, and a Mandatory Cleaning fee after Renter Checkout of 75 Euro, according to our Terms.
Your use of the premises, acceptance of keys, or payment of rent at any time constitutes an acceptance of this agreement in full, including but not limited to policies related to the use of the property, restrictions, obligations, and all other terms outlined in this agreement or any future amendments made by The Landlord during the term of your rental.
Failure to comply with the terms and conditions of this agreement may result in penalties, including but not limited to financial penalties, termination of the rental agreement, and eviction. The Landlord reserves the right to modify the terms and conditions, with notice to you, in accordance with the laws and regulations governing this agreement.
No Smoking and No Pets Clause
This Rental Agreement, entered into by and between the Renter (“You”) and AlmoradiCityLiving (“The Landlord”), incorporates the following terms regarding smoking and pets on the property:
- No Smoking Policy: You agree and acknowledge that the rental premises, including all interior spaces and common areas, are a smoke-free environment. No smoking of any substances, including but not limited to tobacco, marijuana, e-cigarettes, and any other form of smoke or vapor, is allowed within the rental unit or any common areas associated with the property. This policy is in place to protect the property and ensure a clean and safe living environment for all residents. Violation of this no smoking policy will result in penalties as described in the Enforcement section of this agreement, which may include financial penalties, additional cleaning fees, and possible termination of the rental agreement.
- No Pets Policy: You agree not to keep pets of any kind on the premises. This includes, but is not limited to, dogs, cats, birds, and reptiles. The Landlord reserves the right to withdraw consent at any time if it is found that the pet is causing damage to the property, disturbance to neighbors, or if any aspect of the pet’s presence violates the terms of this agreement. Exceptions to this policy may be made for service animals as required by law, with appropriate documentation provided by You. Violation of the no pets policy may lead to penalties as outlined in the Enforcement section of this agreement, including but not limited to financial penalties, removal of the pet from the premises, and possible termination of the rental agreement.
Violations of the No Smoking and No Pets policies are considered breaches of this rental agreement and will incur a fee of 250 euro for Addtional extra cleaning that will be paid by the renter. The Landlord reserves the right to enforce penalties, including issuing warnings, assessing financial penalties against the security deposit or through additional charges, demanding immediate corrective actions.
Financial Liability for Misuse and AbuseÂ
This Rental Agreement, made between the Renter (“You”) and AlmoradiCityLiving (“The Landlord”), sets forth the terms under which you agree to rent the property from The Landlord. A key aspect of this agreement is your responsibility towards the property and its contents.
Responsibility for Property: You acknowledge and agree that you are fully responsible for the interior of the rental property, including but not limited to furniture, kitchen appliances, fixtures, and all other items provided by The Landlord, in the same condition as at the start of the rental term, normal wear and tear excepted.
Financial Liability: You agree to be financially liable for any misuse, neglect, damage, or abuse of the property’s interior, furniture, kitchen appliances, fixtures, and any other items within the rental property caused by you, your guests, or any other person under your control. Misuse and abuse include, but are not limited to, intentional damage, negligence, and failure to use the property and its contents in a manner for which they were intended.
Damage Assessment and Repairs: In the event of damage, The Landlord will assess the necessary repairs or replacement costs. You agree to cover these costs in full, upon demand, or The Landlord may deduct such costs from your security deposit. Should the security deposit be insufficient to cover the costs of repairs or replacements, you agree to pay the additional amount required promptly upon receipt of an invoice or written demand from The Landlord.
Reporting Obligations: You are obligated to report any damage to the property or its contents immediately upon discovery to The Landlord. Failure to report damages may result in increased repair costs for which you will be held financially responsible.
Enforcement: Violation of this clause constitutes a breach of this Rental Agreement and may result in penalties, including but not limited to financial liability for repairs, replacement costs, termination of the rental agreement, and legal action if necessary.
Non-Refundable Payment Clause for Failure to Check-In or Vacate
This clause is an integral part of the Rental Agreement entered into by the Renter (“You”) and AlmoradiCityLiving (“The Landlord”), pertaining to the rental located at [Property Address].
- Failure to Check-In: You agree that in the event you fail to show up at the property to check in on the agreed-upon date and time without prior notification and arrangement with The Landlord, all payments made towards the rent, including any and all deposits, shall be non-refundable. This policy is in place to compensate for the potential loss of rental income and administrative costs incurred by The Landlord due to the unavailability of the property for other prospective renters.
- Failure to Vacate: Similarly, if you fail to vacate the rental property by the agreed-upon check-out date and time, you understand and agree that all payments made, including deposits, will not be refunded. Additionally, you may be liable for additional charges, including but not limited to, costs associated with relocating subsequent renters, additional rental days, and any legal fees incurred by The Landlord in regaining possession of the property.
Notice and Communication: It is your responsibility to communicate with The Landlord in a timely manner if there are any changes to your planned check-in or check-out that might affect your stay. The Landlord agrees to reasonably accommodate changes subject to availability and may require additional fees for alterations to the original booking.
Cancellation Policy
This Cancellation Policy is a crucial part of the Rental Agreement between the Renter (“You”) and AlmoradiCityLiving (“The Landlord”), regarding your stay at our property located just 200 meters from the town square of Almoradi, Spain.
- Cancellation Notification: To cancel your booking, you must notify The Landlord in writing. Email notifications are acceptable and must be sent to info@almoradicityliving.com.
- Refund Policy:
- More than 30 days before check-in: If you cancel your booking more than 30 days before your scheduled check-in date, you will receive a full refund of any rental payments made, excluding the paid rental deposit.
- 14 to 30 days before check-in: Cancellations made between 14 to 30 days before the check-in date will result in a 50% refund of the total rental amount, excluding the paid rental deposit. Less than 14 days before check-in: No refund will be issued for cancellations made less than 14 days before the scheduled check-in date.
- Modifications: If you need to modify your booking dates, we will do our best to accommodate your request based on availability. Such modifications may be subject to additional charges or rate adjustments.
- Delayed Arrival Notification: If your arrival is delayed, you must notify The Landlord in writing with details of new arrival time and new flight number and no refunds will be made for lost days of the week rental. Email notifications are acceptable and must be sent to info@almoradicityliving.com.
- No-Shows: Failure to arrive on your scheduled check-in date without prior cancellation notification will be treated as a “No-Show,” and no refund will be issued.
- The renter agrees to the following:Â If the renter lose the Apartment & Building Keys an additional Apartment & Building key replacement Fee of 250 Euro will be invoiced to you for replacing the Apartment & Building Keys in the whole Building and You must contact the Landlord ASAP via Whatsapp +45 4270 6161 and Email with details of the event must be sent to info@almoradicityliving.com
